As we rang in the New Year of 2015, we are ringing in very few big changes to laws that apply to most of the public. Sure, there are plenty of small changes, but few will impact your life directly.
So, what should you be worried about these days? The ability to fight back against the State if you are accused of a DWI is more difficult because of the blood warrants that the DA’s Office in Harris County gets in most cases now. Don’t get me wrong – you can fight them. However, there are more scientific details that your criminal defense attorney must be up to date on so they may defend you properly.
How do you know if your lawyer is up to date on the science? Just ask them! As defense attorneys, we take many hours of continuing legal education every year. In addition, those who handle DWI, should take classes specifically regarding DWI and blood testing.
Personally, I have taken years of classes and continuing education on these topics. However, none of us can be an expert in this field. If necessary, I never hesitate to hire an expert to advise on a DWI case involving breath and/or blood evidence. The “expert” is worth every penny!
Ask the DWI lawyers you interview and make sure your lawyer is educated in your particular area of interest!
